By accessing or using the Service, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree, do not access or use the Service. --- ## 1. Description of Service SketchMonkey is an agentic AI-driven industrial design, concept rendering, and creative operating system. The Service allows users to: - Formulate and refine design briefs through five distinct creative lenses: Maya (Pragmatic/Ergonomic), Ren (Braun/Rams Minimalist), Zola (Avant-Garde/Brutalist), Kai (Futuristic/Commercial), and Nova (Biomimetic/Organic). - Generate high-fidelity concept imagery, CMF (Color, Material, Finish) specifications, and Google Veo 3.1 video turnarounds. - Author multi-format campaigns and typography-layered posters with 300 DPI export capabilities. - Integrate automated workflows via the Model Context Protocol (`/api/mcp`) and ChatGPT Plugin (`/api/gpt/*`). - Conduct autonomous pay-per-call compute settlements via the Machine Payments Protocol (MPP HTTP 402). --- ## 2. Intellectual Property & Commercial Ownership ### A. 100% User Ownership of Outputs - **You own all commercial rights, title, and interest in and to the images, videos, vector artboards, typography layouts, and design specifications generated by you through the Service ("Generated Content").** - You are free to exploit, license, sell, manufacture, merchandise, and distribute Generated Content worldwide for any commercial purpose (including client work, physical manufacturing, advertising, packaging, and digital media) without payment of royalties or mandatory attribution. ### B. Company Intellectual Property - The Company retains all proprietary rights, copyright, and trademarks in the SketchMonkey platform, interface design, brand identity, underlying source code, algorithmic compilers, and software documentation. --- ## 3. Acceptable Use Policy You agree not to use the Service to: 1. Generate, upload, or transmit any content that is illegal, defamatory, obscene, harassing, promoting hate speech, depicting non-consensual sexual content, or exploiting minors (CSAM). 2. Infringe upon or violate the intellectual property, privacy, or publicity rights of any third party. 3. Transmit malicious software, viruses, or code designed to disrupt, compromise, or damage server infrastructure. 4. Attempt to reverse engineer, decompile, extract weights, or reconstruct the underlying generative models, except to the extent permitted by applicable mandatory law. 5. Circumvent, disable, or tamper with security measures, rate limiters, or billing mechanisms. 6. Conduct automated denial-of-service or scraping attacks against the platform. Violation of this section constitutes grounds for immediate termination of access without refund. --- ## 4. Subscriptions, Pricing & Billing ### A. Plan Tiers & Allowances - **Free Trial:** Anonymous exploratory quota with subtle SketchMonkey badge. - **Chimp Tier (€9 / month, or €90 / year):** Solo creator tier offering 60 renders/day and 4-variation batches. - **Gorilla Tier (€29 / month, or €290 / year):** Pro studio tier offering 200 renders/day, unwatermarked exports, and Google Veo 3.1 video generation. - **Silverback Tier (€99 / month, or €990 / year):** Agency tier offering 1,000 renders/day, 3 team seats, priority compute, and dedicated API access. ### B. Machine Payments (MPP HTTP 402) - Autonomous AI agents may purchase individual render dispatches via HTTP 402 without an account: - Single Variation: **EUR 0.50** - 4-Variation Batch: **EUR 1.50** - Charges are settled per call using Stripe Link shared tokens. ### C. Renewal & Cancellation - Paid subscriptions renew automatically at the conclusion of each billing period (monthly or annually) unless cancelled before the renewal date. - You may cancel your subscription at any time via the Stripe Customer Portal accessible from your [Profile](/profile) or [Pricing](/pricing) page. Upon cancellation, your plan remains active until the end of your current paid billing period. ### D. Refund Policy - If a technical error or persistent system outage prevents the delivery of a paid generation job, our system attempts an automated refund. - For billing disputes or manual refund requests, contact **[3d@neuraldeep.net](mailto:3d@neuraldeep.net)** within 14 calendar days of the charge. --- ## 5. ChatGPT Plugin & API Usage - When using the SketchMonkey ChatGPT Plugin or MCP endpoints, you agree to comply with all applicable OpenAI Platform Policies and Model Context Protocol specifications. - We reserve the right to throttle or suspend API keys or IP addresses that generate excessive traffic, abuse computational capacity, or violate our Acceptable Use Policy. --- ## 6. Disclaimers & Limitation of Liability ### A. "As Is" Warranty Disclaimer The Service is provided on an **"AS IS"** and **"AS AVAILABLE"** basis without warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. Generative AI by nature produces probabilistic outputs; we do not warrant that outputs will be error-free, uninterrupted, or meet every subjective aesthetic expectation. ### B. Limitation of Liability To the maximum extent permitted by applicable law, in no event shall Neural Deep Network Ltd, its directors, employees, or partners be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of profits, data, or goodwill) arising out of or related to your use of the Service. The Company’s total aggregate liability for any and all claims shall not exceed the greater of **one hundred euros (€100.00)** or the total amount paid by you to the Company in the twelve (12) months preceding the incident. --- ## 7. Governing Law & Dispute Resolution These Terms and any disputes arising out of or relating to them shall be governed by and construed in accordance with the laws of the **Republic of Malta** and the **European Union**, without regard to conflict of laws principles. Any legal proceedings shall be subject to the exclusive jurisdiction of the competent courts of Malta. --- ## 8. Modifications to Terms We may revise these Terms periodically. Substantial changes will be posted on this page with an updated "Effective Date." Your continued use of the Service following such updates signifies your acceptance of the revised Terms. --- ## 9.
